Oppose the DOJ’s Ethics Shield Rule

No lawyer should be above the ethical rules that govern the profession. Not even lawyers for the Department of Justice. A proposed new DOJ rule would give the Attorney General the right to interpose herself into state bar ethics investigations of current and former DOJ attorneys, delaying such investigations, perhaps indefinitely, while the DOJ investigates itself. A federal law requires DOJ attorneys to comply with the ethical rules of the states in which they practice. The new rule would thwart timely state bar oversight of the ethical conduct of federal prosecutors — the same disciplinary system to which every other licensed attorney in America is subject. Public comments are open until April 6, 2026.

Georgia Lawyers for the Rule of Law is urging all members of the bar to oppose this rule and make their voices heard. Submit your comment, write an article, contact your bar association.

The framework of attorney ethical rules has protected the public and the integrity of our legal system for over a century. We cannot allow any administration to place itself beyond its reach.
