January 28th FBI raid on Fulton County Elections Office
Atlanta, GA — Georgia Lawyers for the Rule of Law (GLRL), a nonpartisan organization of more than 750 Georgia lawyers, is deeply concerned by the execution of a search warrant by the FBI on January 28 on the Fulton County Elections Office. Given the gravity of this action and its implications for election integrity, federalism, and the rule of law, GLRL raises the following urgent questions:
- The 2020 election in Georgia has been investigated and litigated multiple times with no findings of fraud or criminal activity. What was the legal justification for the issuance of a search warrant in this case? In order for a search warrant to issue, the government must allege in a sworn affidavit that it is in possession of evidence that a crime has occurred and evidence of that crime is at the place to be searched. What is the evidence the government cited in its affidavit?
- On what legal and evidentiary basis, did U.S. Attorney General Pamela Bondi grant authority to an interim U.S. Attorney in Missouri to conduct a nationwide investigation of alleged election fraud?
- While affidavits for federal search warrants are routinely sealed, should the affidavit in this case be unsealed in the public interest so the nation knows the allegations supporting issuance of the search warrant?
- Are these actions meant to interfere in the 2026 elections in Georgia?
- What are Georgia’s top elected officials and the State Election Board going to do in response, and will they protect Georgians’ right to vote?
- What national security issues are raised in the affidavit for the search warrant that would justify the extraordinary presence at the scene of Director of National Intelligence Tulsi Gabbard?
- Is this retaliation on the part of the President against a state that voted against him in 2020
- Is it a precursor for an effort to take control of the Fulton County Elections Office?
The answers to these questions — and many others that continue to emerge — are central to preserving public trust and the rule of law in Georgia. We urge members of the media, public officials, and concerned citizens to demand transparency and accountability from both state and federal authorities.
